User Agreement

This user agreement is effective for all users of the UCanPay® E-Wallet as of December 26, 2020.

This agreement is a contract between you and Antario Financial and Payment Services Inc. and its affiliates (collectively known as "UCanPay®"), governing your use of your UCanPay® E-Wallet account and UCanPay® services. It applies only to UCanPay® E-Wallet accounts. You must be an individual and a resident of Canada and at least 18 years old, or the age of majority in your province of residence, to open a UCanPay® E-Wallet account and use the UCanPay® services. If you are a business, you must register for a UCanPay® Merchant account (refer to the "UCanPay® Merchant Payment Service Agreement").

Agreement Acceptance

By opening and using a UCanPay® E-Wallet account, you agree to comply with all terms and conditions in this user agreement. Please read all terms carefully.

Amendments

We may amend this agreement from time to time. The revised version will be effective immediately when posted unless noted otherwise. If changes reduce your rights or increase your responsibilities, we will provide at least 30 days' notice on the Policy Updates page of our website (www.ucanpay.ca) and notify you directly.

If you disagree with the revised terms, you must stop using UCanPay® services, close your account, and terminate your relationship with us without cost or penalty.

Account Opening

We offer E-Wallet accounts only to individual customers. The UCanPay® E-Wallet account allows you to make payments and top up your E-Wallet using various methods such as EFT, Interac, Visa Direct, Visa Debit, or Master Debit linked to your bank accounts.

You must keep all account details confidential and are responsible for all activities under your account. Notify us immediately at www.UCanPay.ca if you suspect your account has been compromised.

Account Use

  • Adding Money: Before making a payment, top up your E-Wallet from one of your bank accounts.

  • Withdrawing Money: You may transfer your E-Wallet balance to the linked bank account. Fees applicable will be disclosed each time you initiate a withdrawal.

Responsibilities

  • You are responsible for keeping your contact information up to date.

  • Ensure sufficient funds are available in your bank accounts to cover any transactions and fees.

  • Review your account statements regularly to verify all transactions.

Restricted Activities

You agree not to use the UCanPay® services for any unlawful or fraudulent activities, including but not limited to:

  • Engaging in behavior that results in an unauthorized transaction or may involve financial loss to anyone.

  • Violating any law, statute, ordinance, or regulation.

Holds and Limitations

UCanPay® may place holds, limitations, or reserves on your account based on certain factors including, but not limited to, transaction activity and perceived risk levels. Details of any holds or limitations will be provided to you.

Account Termination and Suspension

UCanPay® reserves the right to suspend or terminate your account if activities violate the terms of this user agreement.

Disputes

Any disputes regarding unauthorized transactions or errors must be reported immediately. UCanPay® provides mechanisms for the resolution of such issues.

Governing Law

This agreement shall be governed by and interpreted under the laws of the Province of Ontario and the federal laws of Canada.
